Wills & Estate Planning NSW

In New South Wales, wills are governed by the Succession Act 2006. A will is a binding and enforceable legal document that appoints executors, who are the person with authority to deal with your assets and administer your estate, and also appoints beneficiaries who will receive gifts of property under the will.  The term ‘property’ includes real estate, cash, shares, motor vehicles, household and personal effects.


Although will planning and estate planning can be seen as one and the same, the latter goes further, recording your wishes regarding your health, finances, and more.


When going about planning your estate or making a will, it is helpful first to itemise your property, including bank accounts, land, shares and other assets, and also to assemble a list of any debts, review your superannuation accounts, update your insurance, and make a list of the persons you wish to confer a benefit upon under your will. Ideally, that list will include the full names and addresses of each person you wish to include in your will.

We also can assist in matters relating to estate administration, including obtaining a grant of probate in either NSW or QLD as required, and settling estate debts. We can also provide preliminary advice in relation to estate litigation matters, involving either court proceedings already commenced or contemplated proceedings, regarding the validity of a will or a persons' eligibility to contest a will. Whilst we are not able to accept instructions to conduct litigation in relation to wills or deceased estates, we can provide preliminary advice and refer you to a trusted colleague who is able to conduct or defend such litigation on your behalf.
